1. Scope and Legal Basis

These Warranty Terms set out the conformity guarantee and commercial warranty conditions applicable to Goods purchased through the Addmeon online store, operated by Cnergy SIA, Reg. No. 40103709466, VAT No. LV40103709466, Riga, Latvia (hereinafter — Seller).

These Warranty Terms are based on and must be read together with:

  • The Consumer Rights Protection Law of the Republic of Latvia (Patērētāju tiesību aizsardzības likums);
  • Cabinet Regulation No. 631 (Warranty Procedure Regulations);
  • Directive (EU) 2019/771 on contracts for the sale of goods;
  • The Civil Law of the Republic of Latvia, where applicable to transactions with legal entities.

These Warranty Terms apply to all Buyers, with specific provisions distinguished below depending on whether the Buyer is a Consumer (natural person purchasing for non-commercial purposes) or a Legal Entity (company or other legal person purchasing for business purposes).

2. Legal Conformity Guarantee

The Seller is responsible for ensuring that all Goods sold through the Store conform to the Contract at the time of delivery. Goods do not conform to the Contract if they:

  • Do not match the description, type, quantity, quality, functionality, or other characteristics specified in the Contract;
  • Are not fit for the specific purpose communicated by the Buyer to the Seller prior to purchase;
  • Are not fit for the purposes for which goods of the same type would normally be used;
  • Do not come with the accessories, packaging, instructions, or after-sales support that the Buyer may reasonably expect;
  • Are not of the quality and performance which the Buyer may reasonably expect, taking into account public statements made by the Seller, the manufacturer, or their representatives.

3. Warranty Period

The warranty period applicable to Goods purchased in the Store depends on the type of Buyer:

For Consumer Buyers, during the first 12 months from delivery, any lack of conformity that becomes apparent is presumed to have existed at the time of delivery, unless the Seller proves otherwise or this presumption is incompatible with the nature of the Goods or the nature of the lack of conformity. From month 13 to month 24, the burden of proof shifts to the Consumer to demonstrate that the defect existed at the time of delivery.

The warranty period is suspended for the duration of any warranty repair. Upon return of the repaired Goods to the Buyer, the remaining warranty period continues from the day of return. If the Goods are replaced with new Goods under warranty, the full warranty period restarts from the date of delivery of the replacement Goods.

4. Submitting a Warranty Claim

To submit a warranty claim, the Buyer must contact the Seller as soon as the defect is discovered and in any event within the applicable warranty period. A warranty claim can be submitted by:

  • Order number and date of purchase;
  • Name and model of the product;
  • A clear description of the defect or non-conformity;
  • Photographs or video evidence of the defect, where applicable;
  • Proof of purchase (order confirmation e-mail or invoice).

The Seller will acknowledge receipt of the warranty claim within 3 business days and will provide a substantive response and proposed resolution within 15 business days of receiving the Goods (if return is required) or from the date of the claim (if remote assessment is sufficient).

5. Warranty Remedies

Where a valid warranty claim is accepted, the Buyer is entitled to the following remedies, applied in the following order of priority, as determined by the Seller unless the preferred remedy is disproportionate:

  1. Repair — the Seller will repair the defective Goods free of charge within a reasonable time and without significant inconvenience to the Buyer;
  2. Replacement — if repair is not possible or disproportionate, the Seller will replace the Goods with an equivalent item of the same model and specification, or a comparable model with the Buyer's consent;
  3. Price reduction — if repair and replacement are not possible or have not resolved the non-conformity, the Buyer may request an appropriate reduction of the purchase price;
  4. Refund — if repair and replacement have failed, are impossible, or the Seller has refused to remedy the defect, the Buyer may withdraw from the Contract and receive a full refund of the purchase price.

Warranty repairs will be completed within 30 calendar days if serviced by a repair centre in Latvia, or within 45 calendar days if serviced by an authorised service centre outside Latvia. If this timeframe cannot be met, the Seller will notify the Buyer and agree on an extended timeline.

All warranty remedies are provided free of charge to the Buyer. The Seller bears the cost of return shipping for warranty claims where the defect is confirmed, subject to the conditions set out in Section 6 below.

6. Return of Goods for Warranty Assessment

Where physical inspection or repair of the Goods is required, the Buyer must return the Goods to the Seller. Prior to returning Goods, the Buyer must receive written confirmation from the Seller with return instructions. Goods returned without prior authorisation may not be accepted.

Goods must be returned securely packaged to avoid damage in transit, preferably in the original packaging. All original accessories, documentation, and components must be included. The Buyer must include a copy of the purchase confirmation and a written description of the defect.

For products weighing less than 10 kg, the Buyer delivers the Goods to the agreed dispatch point or courier. For products weighing between 10 kg and 20 kg, Latvian Post or another agreed carrier may be used at the Seller's expense upon confirmation. For products weighing over 20 kg, delivery arrangements will be agreed individually with the Seller.

If the warranty inspection reveals that the defect is covered by the warranty, the Seller bears the cost of return shipping. If the defect is found to be excluded from warranty coverage (see Section 7), the Buyer bears all shipping and inspection costs and the Goods will be returned as received.

7. Warranty Exclusions

The warranty does not cover defects or damage resulting from:

  • Normal wear and tear consistent with the intended use of the product;
  • Mechanical damage caused by the Buyer, including drops, impacts, pressure, or liquid damage;
  • Use of the Goods contrary to the manufacturer's instructions, technical specifications, or intended purpose;
  • Unauthorised modifications, repairs, or opening of the product by parties other than the Seller or authorised service centres;
  • Use of non-original or incompatible accessories, chargers, or consumables;
  • Damage caused by power surges, overvoltage, or improper electrical connection;
  • Damage caused by external factors including fire, flood, lightning, or other force majeure events;
  • Cosmetic damage that does not affect the functionality of the product (scratches, dents, broken plastic on ports);
  • Products with removed, damaged, or altered serial numbers, IMEI, or warranty stickers;
  • Expendable parts such as batteries, unless the damage has resulted from a manufacturing defect.

8. Manufacturer's Guarantee

In addition to the Seller's statutory warranty obligations, certain Goods may be covered by a separate manufacturer's guarantee. Any manufacturer's guarantee is provided voluntarily by the manufacturer and is in addition to — and does not replace or limit — the Buyer's statutory rights under the legal conformity guarantee. The terms and duration of the manufacturer's guarantee are specified in the product documentation included with the Goods. Claims under a manufacturer's guarantee should be submitted directly to the authorised manufacturer service network. The Seller will assist the Buyer in identifying the appropriate service centre upon request.

9. Refund Procedure

Where a refund is due under these Warranty Terms, the Seller will process the refund within 14 calendar days from the date the decision to refund is made (and, where Goods have been returned, from the date of receipt and inspection of the returned Goods). Refunds are issued via the same payment method used for the original transaction, unless the Buyer has expressly agreed to an alternative method. Where the Seller has determined that the defect resulted in wear or benefit to the Buyer, a proportionate deduction may be applied in accordance with Section 28(5) of the Consumer Rights Protection Law, applicable to Consumer Buyers only.

10. Dispute Resolution

If a warranty dispute cannot be resolved directly between the Buyer and the Seller, Consumer Buyers may contact:

These Warranty Terms do not restrict any mandatory rights of the Buyer under applicable consumer protection legislation. Where any provision of these Terms conflicts with mandatory law, the mandatory law prevails.
